ValoJen Systems Acceptable Use Policy

This policy is designed to protect the quality and integrity of the VoIP network and in doing so ensure all customers receive fair and equitable access. The policy specifically relates to usage of unlimited minutes for residential and business calling plans. ValoJen Systems offers various calling plans with several features enabling customers the ability and freedom to make calls without the minute limits associated with most calling plans.
We may depend on our Acceptable Use Policy in circumstances where your usage of untimed call charges that form part of a pricing plan or promotional offer is considered to be excessive or unreasonable.
We retain the right to vary the terms of the Fair Use policy at our discretion from time to time.

Normal/ Excessive Use

ValoJen Systems’ unlimited service plans and features are intended for use solely for normal residential or personal use, limited to the personal use of the residential account holder and immediate family who reside with the account holder and ValoJen Systems’ unlimited small business plans and features are intended solely for normal commercial use by small businesses and home offices.
Our voice service plans are designed only for continuous live dialog between two individuals. We consider excessive use to be a call duration that’s more than the allotted minutes for normal calling or a regularity of calling that indicates that the service is not being used for its initial intended use when applied for.
If your use of the plan is excessive or unreasonable we will contact you by phone or email, using the contact details you have provided to us. If after our request your usage continues at a similar level we may upgrade your service to an appropriate residential or business plan, then charge you at the rates for that plan backdated to when we made contact.

Lawful and Appropriate Purposes

ValoJen Systems service and devices provided for use with such service may not be used in any way that is illegal, fraudulent, improper or inappropriate. It is prohibited to use any automated means to manipulate our service, use our service to violate any law, rule, or regulation, violate any third party's intellectual property or personal rights or exceed permitted access to our service.

ValoJen Systems Rights

- suspend your access to that offer, or

- suspend or cancel your service.

Immediately and without any prior warning or notice given to you.

If we believe that our service has been used for an unlawful purpose, we may forward the relevant communication and other information, including the account holder's identity, to the appropriate authorities for investigation and prosecution.
We retain the right to vary or make changes to the terms of the Acceptable Use policy at our discretion from time to time. Changes shall become effective when the adjusted Policy is posted to ValoJen Systems” website.

Discounts and discounted calls on packages offered applies to unlimited plans only and does not apply to Cell Phones Numbers or to Special

Services Numbers such as Toll-Free or Caller-Paid Information Services or 900 Numbers, and is limited only to the locations identified in the

packages and are when offered are valid for Unlimited plans only. In reference to unlimited minutes, ValoJen Systems adheres to its

Acceptable Use Policy which residential and business customers are encouraged to take note, as it makes reference to normal, excessive and

acceptable use of the unlimited minutes. Unlimited calling and other services are based on normal residential use. ValoJen Systems 911

(E911) functions differently from that of the traditional 911 service. For more information on how ValoJen Systems 911 service works, see

http://www.valojen.com/valojen911.htm. ValoJen Systems phone rates exclude: activation fees, regulatory recovery fees, 911 fees and cost

recovery, premium services, equipment, taxes, termination, shipping charges, directory assistance or broadband service. International calls

are charged per minute. ValoJen Systems phone rates may vary by region. Prices are subject to change. High Speed (broadband) Internet

connection and a credit card required for ValoJen Systems phone services. ValoJen Systems VoIP service may not work with all systems.
